These Terms of Service ("Terms") are an agreement between you and CPO PRO ("CPO PRO," "we," "us," or "our"), operated by Samuel Holmes, a PHTA Certified CPO Instructor based in Las Vegas, Nevada. By using cpopro.com or enrolling in a class, you agree to these Terms.
Our Services
CPO PRO provides Certified Pool Operator (CPO) training and exam proctoring. Classes are offered live online over Zoom, in person in Las Vegas, and on-site at your facility. We are an independent, PHTA Certified CPO Instructor. The CPO credential itself is issued by the Pool & Hot Tub Alliance (PHTA), not by CPO PRO, and is subject to PHTA's standards and requirements.
Enrollment and Payment
The standard fee is $435 per student unless otherwise stated. Payment is collected at the time of booking through our payment provider, Stripe. Your seat is reserved once payment is confirmed. Prices, dates, and availability may change, but any change will not affect a class you have already paid for.
Rescheduling and Cancellations
We understand that plans change. You may reschedule to a later class at no charge if you contact us at least 48 hours before your scheduled class. Cancellations requested at least 7 days before the class are eligible for a refund, less any non-refundable PHTA materials or processing fees that have already been incurred. Late cancellations and no-shows are non-refundable, though we will do our best to move you to a future date. To reschedule or cancel, email sam@cpopro.com.
Certification and Results
To earn certification, you must complete the required PHTA pre-study and pass the PHTA CPO exam, which requires a score of 70 percent or higher. We provide thorough instruction, materials, and support, but we cannot and do not guarantee that you will pass. The certification is valid for five years, and renewal is governed by PHTA's requirements in effect at that time.
Course Materials and Intellectual Property
All CPO PRO course materials, website content, and branding are provided for your personal, individual use in connection with your certification. You may not copy, record, redistribute, resell, or use them to deliver training to others. PHTA materials remain the property of PHTA and are subject to PHTA's terms.
Acceptable Use
You agree to use our website and services lawfully and not to disrupt them, attempt unauthorized access, or interfere with other users. We may suspend access if these Terms are violated.
Disclaimers
Our services and website are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose. Information on our website, including compliance and regulatory topics, is general in nature and is not legal advice. Health and safety requirements vary by state and locality, and you are responsible for confirming the rules that apply to your facility with your local health authority.
Limitation of Liability
To the maximum extent permitted by law, CPO PRO will not be liable for any indirect, incidental, or consequential damages arising from your use of our website or services. Our total liability for any claim relating to a class is limited to the amount you paid for that class.
Indemnification
You agree to hold CPO PRO harmless from claims, losses, or expenses arising out of your misuse of our website or services or your violation of these Terms.
Governing Law
These Terms are governed by the laws of the State of Nevada, without regard to its conflict of laws rules. Any dispute relating to these Terms or our services will be handled in the state or federal courts located in Nevada.
Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the site or services after changes take effect means you accept the updated Terms.
